These Terms govern your use of the JSsec website, the free tools, and the malware and abuse reporting form.
These Terms of Service ("Terms") apply to your use of the JSsec website at jssec.co.uk and jssec.com (the "Website"), the free tools we make available on it (the "Free Tools"), and the malware and abuse reporting form (the "Report Form"). They are entered into between you and JSsec Ltd, a company registered in England and Wales (company number 15774465), whose registered office is at 3rd Floor, 86-90 Paul Street, London, England, EC2A 4NE ("JSsec", "we", "our", "us").
By using the Website, the Free Tools or the Report Form, you agree to these Terms. If you do not agree, do not use them.
The Website is intended for business use. By using it you confirm that you are acting for a business and have authority to bind that business to these Terms.
The Website describes our services (continuous phishing and brand-abuse detection and takedown coordination, together the "Services") for information only. Nothing on the Website is an offer capable of acceptance, a quotation, or a commitment to provide the Services.
We do not sell the Services on a self-service basis and we do not publish prices. The Services are provided to business customers under a separate written Master Services Agreement and one or more Order Forms (together, the "MSA"). If you are a customer under an MSA, that agreement governs the Services and prevails over these Terms to the extent of any conflict concerning the Services. These Terms govern only your use of the Website, the Free Tools and the Report Form.
Using the Website, requesting a demo, or contacting us does not create a contract for the Services and does not oblige us to provide them. A contract for the Services is formed only when an MSA and Order Form are signed by both parties.
For information, our Services may include: monitoring across web, email and dark web sources for impersonation of a customer's brand; detection of brand-impersonation, fraudulent "fake shop" and logo- or image-based abuse; malware detection; and submission of takedown requests to the responsible registrars, hosts, CDNs, platforms and safe-browsing services, tracked through to closure. To detect and act on threats we may share indicators (such as URLs, screenshots and page content) with these providers and partners.
The Services are provided with reasonable care and skill under the MSA. We do not guarantee that all phishing, malware or malicious sites will be detected, or that any takedown will succeed or complete within any particular timeframe. Service levels, where they apply, are set out in our published SLA and in the relevant MSA. Authority for us to act on a customer's behalf is given under the MSA and Order Form, not through use of the Website.
We make free diagnostic tools available on the Website: our DMARC and BIMI checker, and our SPF record tree viewer. The Free Tools are provided free of charge, for information only, and on an "as is" and "as available" basis. To the maximum extent permitted by law we accept no liability for the Free Tools or their output (see Limitation of liability).
The Free Tools do not constitute professional, security or legal advice, and you should not rely on their output as your sole basis for any decision. We do not warrant that their results are accurate, complete or current, or that the Free Tools will be available or uninterrupted. We may change, limit or withdraw any Free Tool at any time.
When using the Free Tools you must not: query domains or systems you do not own or are not authorised to assess; make automated, bulk or excessive requests, or scrape the tools or their output; attempt to disrupt, overload, reverse engineer or circumvent them; or use them for any unlawful purpose. We may apply rate limits and may suspend access for misuse.
The Report Form (at /report) lets you tell us about a suspected phishing, malware or brand-abuse website. You do not need an account. It asks for the suspect URL or URLs and the type of abuse, and optionally any further detail and your email address; if you are the brand or person being impersonated, we ask for your email so our takedown team can reach you.
When you submit a report, you confirm that you are entitled to share the information in it and that it is accurate to the best of your knowledge. You must not submit unnecessary personal data, the confidential information of others without the right to do so, or any live malware, exploit code or malicious payload.
We aim to triage each report, have an analyst assess it, and escalate confirmed cases to the responsible registrar, host or CDN. Even so, we are under no obligation to review, respond to, act on, investigate or retain any report; we give no guarantee of any outcome or timeframe; and we give no undertaking to keep a report confidential. A report does not create any contract, engagement or relationship between us, and no payment is due for it.
You grant JSsec a non-exclusive, royalty-free, worldwide, perpetual licence to use the information in your report, including to detect and validate threats, produce threat intelligence, conduct security research, coordinate takedowns with third parties, and improve the Services.
When using the Website, the Free Tools and the Report Form you must: use them only for lawful purposes and in accordance with these Terms; not interfere with or attempt to gain unauthorised access to them or any connected system, network or data; not probe, scan or test their vulnerability without our written consent; not introduce malware or harmful code; not copy, scrape, reverse engineer or create derivative works from them except as allowed by law; and not misrepresent your identity or affiliation. We may suspend or withdraw your access if you breach this section.
The Website, the Free Tools, our software, and all content, branding and detection data are owned by JSsec or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Website and Free Tools for your own internal business purposes. You may use the output of a Free Tool for your own internal business purposes. No other rights are granted, and nothing in these Terms transfers any intellectual property to you.
Our handling of personal data is described in our Privacy Policy and Cookie Policy. For personal data collected through the Website (including enquiries, demo requests and marketing), JSsec is the controller under the UK GDPR and the Data Protection Act 2018, and you may complain to the Information Commissioner's Office.
Where we process personal data in providing the Services to a customer, we act as that customer's processor under the Data Processing Agreement that forms part of the MSA. That processing is governed by the DPA, not by these Terms.
The Website may link to third-party sites and resources. We provide these for convenience and are not responsible for their content, availability or practices. Your use of a third-party site is at your own risk and subject to that site's own terms.
We provide the Website, the Free Tools and the Report Form on an "as available" basis and may change, suspend or withdraw all or part of them, with or without notice. We are not liable to you for any unavailability of the Website or the Free Tools. Service availability commitments, where they apply, are set out in the MSA and the SLA, not in these Terms.
To the maximum extent permitted by law, the Website, the Free Tools and the Report Form are provided "as is" and "as available" without warranties of any kind, whether express or implied, including as to accuracy, availability, or fitness for a particular purpose. Warranties relating to the paid Services are set out in the MSA and not here.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under the law of England and Wales.
Subject to that, and because we provide the Website, the Free Tools and the Report Form free of charge and for information only, we exclude all liability to you arising out of or in connection with your use of them, to the maximum extent permitted by law. This includes any loss or damage, whether direct, indirect or consequential (including any loss of profit, revenue, data, goodwill or anticipated savings), arising from your use of, or reliance on, the Website, the Free Tools, the Report Form, or their output or availability.
Our liability for the paid Services is governed exclusively by the MSA, which caps each party's total liability at the fees paid or payable in the 12 months before the claim, subject to the carve-outs stated in the MSA. This section does not affect those provisions.
You agree to indemnify JSsec against all claims, liabilities, damages, losses and reasonable expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Website, the Free Tools or the Report Form, or the information you submit through the Report Form.
We may suspend or withdraw your access to the Website, the Free Tools or the Report Form at any time, with or without cause and with or without notice. Termination of the paid Services is governed by the MSA. The sections headed Intellectual property, Reporting malware and abuse (as to the licence granted), Disclaimers, Limitation of liability, Indemnity, and Governing law survive any termination.
We may update these Terms from time to time. If we make material changes we will post the updated Terms on this page with a new effective date. Your continued use of the Website, the Free Tools or the Report Form after the changes take effect constitutes acceptance of the updated Terms. Changes to the terms governing the Services are made under the MSA, not by updating this page.
These Terms are the entire agreement between you and JSsec regarding your use of the Website, the Free Tools and the Report Form. A failure to enforce a provision is not a waiver of it. If any provision is found to be unenforceable, the rest continue in effect. These Terms create no partnership or agency between us. You may not assign these Terms without our consent; we may assign them to a successor to our business.
These Terms, and any dispute arising out of or in connection with them, are governed by the law of England and Wales and are subject to the exclusive jurisdiction of its courts.
